Terminology
- The term "you" refers to (but is not limited to) the customer, client, viewer and/or end-user.
- The terms "we", "us" and "our/s" refers to DBS Design and its employees.
- The term "material/s" refers to all work, artwork, imagery, coding and information supplied and owned by DBS Design
- The term "site" and "website" refers to http://dbsdesign.com.au
Copyright
All materials provided by us to you are copyright and have all rights reserved. Materials that belong to third parties have their respective copyrights and rights reserved.
To use any materials in any manner that contravene stipulated rights and licenses by their appropriate and respective owners/licensees will result in direct violation and infringement of copyright and intellectual property rights and as such are subject to litigation based on the terms of violation.
If violations occur, a notice of Copyright & Intellectual Property Infringement will be sent, notifying the offender of the infringed materials, potential ramifications and demand of cease and desist as well as further action that will be taken should the offender fail/refuse to comply.
Availability
We endeavor to ensure that the website is available continuously; however this is not always possible due to issues outside our realm of control. We do not make any warranties that you access will be uninterrupted, timely or error free. Your access to the website may be suspended temporarily due to system failure, technical issues, maintenance, or any other reason beyond our control.
Non-Disclosure
DBS Design respects your rights, artwork and intellectual properties and will only use your property in accordance with the Statement of Agreement signed by both parties (you and us). Your rights and copyrights remain yours and DBS Design will not use, modify or redistribute your artwork without written permission (either formal or electronic) by you.
We guarantee that all information and data provided to us from you (including but not limited to documents, artwork and source-code) will remain entirely confidential unless permission has been provided by you to do otherwise.
We promise that any personal information provided to us by you will not be given to third parties and used for any commercial purposes unless permission is given for such (an example being a newsletter or for us to provide notice to you of upcoming products that you may be interested in).
Services
We reserve the right to change, modify or discontinue any feature or service (or part thereof) at any time without warning. It is policy of DBS Design to notify in advance, clients and/or end-users that might be affected by changes to our services in order to give them fair warning and the ability to change their stance/contract with us so as not to disadvantage our valued clientele.
Contract & Statement of Agreement
Upon verbal agreement with you, we will provide a written/electronic Statement of Agreement identifying the services you have asked for and the cost of these services (quote). This statement must be signed and returned.
